Lending Policy
85 Cash is not a lender. We connect consumers with lenders in our network, and we expect those lenders to treat borrowers fairly and to follow all applicable federal and state laws.
Truth in lending
Before you take on any obligation, your lender must give you, in writing, the APR, finance charge, amount financed, total of payments, payment schedule, and any fees, as required by the federal Truth in Lending Act. See our Rates & Fees page for the range of rates and terms offered by lenders in our network.
Installment loans only
Lenders in our network offer installment loans repaid in multiple scheduled payments, with APRs from 4.95% to 35.95% and repayment periods from 65 days to 84 months. Loans are not rolled over or renewed.
Fair lending
Lenders must comply with fair lending laws, including the Equal Credit Opportunity Act, which prohibits discrimination in any aspect of a credit transaction. The Consumer Financial Protection Bureau (CFPB) enforces federal consumer financial laws.
Fair debt collection
85 Cash does not collect debts. We expect lenders and any collectors they use to follow the Fair Debt Collection Practices Act and similar state laws, which generally prohibit practices such as:
- Calling consumers before 8 a.m. or after 9 p.m. local time
- Harassing, abusive, or threatening calls or language
- False or misleading statements to collect a debt
- Threatening legal action that is not intended or not permitted
If you believe a lender or collector has violated these rules, you can submit a complaint to the CFPB at consumerfinance.gov or to the Federal Trade Commission at reportfraud.ftc.gov, and you may also contact us.
State regulations
Lenders must follow the laws of the states where they operate, including limits on interest rates, fees, loan amounts, and loan terms. Availability varies by state.
